General Terms and Conditions of the E-shop
Introductory Provisions
These terms and conditions (hereinafter referred to as the "Terms") regulate the rights and obligations between the operator of the e-shop, Michala Marešová, ID: 87091585, with registered office at Pod Vysokou 878 Psáry (hereinafter referred to as the "Seller") and the consumer (hereinafter referred to as the "Buyer") when purchasing goods and services via the online store www.equimovex.cz (hereinafter referred to as the "E-shop").
Definitions
Buyer: Any person who places an order on the E-shop.
Seller: Michala Marešová, ID: 87091585.
Goods: Products offered via the E-shop and described on the E-shop's pages.
Conclusion of the Contract
The contract between the Seller and the Buyer is concluded when the Buyer completes the order on the E-shop and the Seller confirms it (order confirmation is sent to the Buyer's email).
The contract is concluded in the English language.
Prices and Payments
The Seller is not a VAT payer.
The price of the goods is valid at the moment the order is placed and may not be the same as the price valid in previous periods.
The purchase price of the goods is due at the time of ordering. The Buyer may choose the following payment methods:
Advance Payment: Bank transfer to account number: 2601493612/2010 or via the payment gateway.
Cash on Delivery: Payment upon receipt of the goods.
Delivery of Goods
The goods will be sent to the address provided by the Buyer in the order.
The Seller agrees to dispatch the ordered goods within the shortest possible time, but no later than the date specified for each product in the order unless otherwise agreed for specific goods.
Delivery is carried out via a selected carrier from the predefined selection and is charged according to the current price list.
The Seller is not responsible for any damage to goods during transportation if the goods are accepted without objection. In the case of damage to the goods during transport, the Buyer is obliged to immediately file a claim with the carrier and inform the Seller about the damage.
Right of Withdrawal
The Buyer has the right to withdraw from the contract within 14 days from the receipt of the goods, without providing any reason. In case of withdrawal, it is recommended to return the goods in the original packaging, undamaged and without signs of use or wear, within the specified period (the date of sending is decisive). If the goods show signs of use or wear (e.g., scratches, dirt, etc.), the Seller has the right, after assessing the condition of the goods, to refund the Buyer an amount corresponding to the current condition of the product, not the full original price.
A written withdrawal request, proof of purchase, contact details (name, address, phone number, or email), and bank account number to which the amount will be refunded must be included with the returned goods.
After receiving the returned goods, the Seller will refund the appropriate amount for the goods within 10 days. The Buyer is responsible for the return shipping costs. The returned goods should be sent to the address: Pod Vysokou 878 Psáry 25244, and the Seller should be informed about the return via email at equimovex@gmail.com.
To withdraw from the contract, the Buyer must inform the Seller of their decision to withdraw by a clear declaration sent via email.
The goods must be returned in the condition they were delivered, including the original packaging, if possible.
The Buyer is responsible for the costs of returning the goods.
Complaints Procedure
The Buyer is obliged to inspect the goods upon receipt and, in case of any defects, to file a complaint as soon as possible.
The complaint will be handled in accordance with applicable legal regulations, either by exchanging the goods or refunding the money.
In case of a valid complaint, the cost of returning the goods is borne by the Seller.
Any complaints will be handled in accordance with the legal order valid in the Czech Republic.
Liability for Defects
The Seller is responsible for defects that appear during normal use of the goods.
The Seller is not responsible for defects caused by improper use of the goods or violation of the usage instructions if those instructions were part of the delivery. Complaints in such cases will not be recognized.
The goods are intended solely for the purposes for which they were designed and manufactured. Using the goods for other than recommended purposes is considered improper, and the Seller is not responsible for defects or damages arising from such use. Complaints in such cases will not be recognized.
Liability for Damages
The Seller is not responsible for damage to property or injury caused by improper or unprofessional use of the goods, including their use for purposes other than usual. The Buyer is obliged to use the goods in a manner that corresponds to their nature and ordinary use. In the case of a violation of these conditions, the Seller does not accept any liability for any resulting consequences.
Personal Data Protection
In accordance with Regulation (EU) 2016/679 (GDPR), the Seller will process the Buyer's personal data solely for the purpose of fulfilling the contract, based on the Buyer's consent.
Details regarding the processing of personal data are provided in the GDPR section.
Consumer Rights
The Buyer is entitled to contact the Seller with a request for compensation if they suffer damage due to a violation of legal regulations.
The Buyer has the right to an out-of-court dispute resolution through the Czech Trade Inspection Authority or the European Online Dispute Resolution (ODR) platform.
Final Provisions
The Seller reserves the right to change these Terms. Any changes will be published on these pages.
These Terms are valid and effective as of January 29, 2025.
These terms and conditions are governed by the legal system of the Czech Republic, especially Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, as amended. Any contractual relations not expressly governed by these terms will be subject to the relevant provisions of these legal regulations.
If any provision of these Terms is in conflict with applicable legislation, the relevant statutory provisions shall apply instead, without affecting the validity of the remaining parts of the Terms.

Introductory Provisions
These terms and conditions (hereinafter referred to as the "Terms") govern the rights and obligations between the operator of the e-shop, Michala Marešová, ID: 87091585, with registered office at Pod Vysokou 878 Psáry (hereinafter referred to as the "Seller") and the consumer (hereinafter referred to as the "Buyer") when purchasing second-hand goods via the online store www.equimovex.cz (hereinafter referred to as the "E-shop").
Definitions
Second-hand Goods: Goods that were previously owned and used but are sold in the condition described in the product description. These may include second-hand, used, refurbished, or repaired goods.
Buyer: Any person who places an order on the E-shop.

Condition and Description of Second-hand Goods
All second-hand products are described in detail on the E-shop's pages, including their condition. The Seller agrees to provide an honest and detailed description of the goods (e.g., wear and tear, minor defects, functionality).
The Seller is not responsible for slight color or appearance variations depending on the Buyer’s screen settings.
Due to the nature of second-hand goods, the goods may be sold "as is," meaning that no standard warranty for new goods is provided.
Right of Withdrawal
In accordance with Section 1837 of the Civil Code, the Buyer has no right to withdraw from the contract if the subject of the sale is goods that were customized according to their wishes or for their personal use (e.g., custom-made goods) or if the goods are used, given the nature of second-hand goods.
Complaints Procedure
For second-hand goods, a warranty is provided only if explicitly stated in the product description. If no warranty is stated, the goods are sold without warranty.
If the Buyer receives goods that do not match the description, they may contact the Seller with a request for a complaint within 7 days of receiving the goods.
The complaint will be resolved by refunding the money. If the complaint is not accepted, the goods remain the property of the Buyer.
Any complaints will be handled in accordance with the legal regulations in the Czech Republic.

Introductory Provisions
These terms and conditions (hereinafter referred to as "Terms") govern the rights and obligations between the operator of the e-shop, Michala Marešová, VAT number: 87091585, with registered office at Pod Vysokou 878, Psáry (hereinafter referred to as "Seller") and the consumer (hereinafter referred to as "Buyer") in relation to the purchase of digital products (video, e-book, etc.) via the online store www.equimovex.cz (hereinafter referred to as the "E-shop").
Definitions
Digital Product: An electronic version of goods that is not provided in physical form, such as video files, e-books, audiobooks, and other digital content.
Buyer: Any person who places an order on the E-shop.
Seller: Michala Marešová, VAT number: 87091585.
Conclusion of the Contract
A contract between the Seller and the Buyer is concluded when the Buyer completes an order on the E-shop and the Seller confirms the order (an order confirmation will be sent to the Buyer's email).
The contract is concluded in the English language.
Upon receipt of the order, a link for downloading the digital product or access details for the video/e-book, etc., will be immediately sent to the Buyer.
Prices and Payments
The Seller is not a VAT payer.
The price for the digital product is due at the time of ordering. The Buyer may choose from the following payment methods:
Prepayment: By bank transfer to account no.: 2601493612/2010 or through a payment gateway.
Delivery of Digital Products
Digital products are made available to the Buyer without undue delay, typically immediately after payment completion.
After the payment is successfully processed, the Buyer will be sent a download link (for e-books) or access to video/files on the platform, etc.
The Buyer is responsible for safeguarding the access details and for downloading the files once they are made available.
Right of Withdrawal
In accordance with § 1837 of the Civil Code, the Buyer acknowledges that due to the nature of digital content, which is provided without the possibility of return, the Buyer may not withdraw from the contract for digital products (video, e-book, etc.) if the Buyer agrees to immediate access to the product before the statutory withdrawal period expires.
If the Buyer explicitly agrees that the product will be made available immediately and that the right of withdrawal is waived, the Buyer will not be entitled to withdraw from the contract under § 1829 of the Civil Code.
Complaints Procedure
The Buyer has the right to file a complaint if the digital product does not meet the specifications provided on the E-shop or if it is in a technical state that prevents its use.
The complaint will be handled within 14 days of receipt. In case the complaint is accepted, the Buyer may be offered new access to the digital product or a refund.
In case of issues with access to the product (e.g., incorrect links or non-functional video), the Seller will ensure that the problem is fixed and alternative access is provided as quickly as possible.
Personal Data Protection
In accordance with Regulation (EU) 2016/679 (GDPR), the Seller will process the Buyer's personal data solely for the purposes of fulfilling the contract, based on the Buyer's consent.

Consumer Rights
The Buyer is entitled to contact the Seller for compensation if damage has been caused to the Buyer through a breach of legal provisions.
The Buyer has the right to out-of-court dispute resolution through the Czech Trade Inspection Authority or the European Consumer Dispute Resolution Platform (ODR platform).
Final Provisions
The Seller reserves the right to change these Terms. Changes will be published on these pages.
These Terms are effective as of 29.01.2025.
These Terms are governed by the laws of the Czech Republic, particularly Act No. 89/2012 Coll., the Civil Code, Act No. 634/1992 Coll. on Consumer Protection, and, in the case of digital content, also Act No. 121/2000 Coll., the Copyright Act, as amended. Any contractual relations not explicitly governed by these Terms will be subject to the relevant provisions of these legal regulations.
If any provision of these Terms is in conflict with applicable legislation, the corresponding statutory provisions will apply instead, without affecting the validity of the other parts of the Terms.
